Terms of Service

1. Acceptance of Terms

By accessing or using Zenian ("the Bot", "the Service", "we", "us"), including the Discord bot, web dashboard, and associated services hosted at zenian.org, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and the Zenian team. We reserve the right to update these Terms at any time, and your continued use of the Service after changes constitutes acceptance.

2. Description of Service

Zenian is a multi-purpose Discord bot and web dashboard platform that provides the following services:

• Roblox Verification: Account linking via Roblox OAuth, automatic role assignment based on Roblox group membership, and user lookup tools
• Server Moderation: Logging, auto-moderation, anti-raid protection, anti-link/anti-ping systems, blacklist management, and infraction tracking
• Ticket System: Multi-panel ticket creation, staff claiming, transcripts, priority levels, tag-based responses, and blacklists
• Automation: Auto-roles on join/screening, welcome/leave messages, reaction roles, sticky messages, and server stat channels
• Staff Management: Infractions, promotions, leave of absence (LOA) tracking, activity monitoring, and hierarchy management
• ER:LC Integration: Emergency Response: Liberty County game server management, command logging, join/leave tracking, and server controls
• Community Features: Giveaways, leveling/XP system, suggestions, staff reviews, reminders, and invite tracking
• Network Management: Cross-server moderation, global bans/kicks, shared blacklists, and multi-server administration
• Web Dashboard: Browser-based configuration interface at zenian.org for managing all bot settings
• Bot Profile Customization: Per-server bot nicknames, avatars, and banners (Premium tier)

3. Eligibility

You must meet the following requirements to use Zenian:

• You must be at least 13 years of age, as required by Discord's Terms of Service
• You must have a valid Discord account in good standing
• You must comply with all applicable local, state, national, and international laws
• You must not have been previously banned or removed from the Service for Terms violations

4. User Responsibilities

As a user of Zenian, you agree to:

• Use the Bot in compliance with Discord's Terms of Service and Community Guidelines
• Use the Bot in compliance with Roblox's Terms of Use when using verification features
• Not attempt to abuse, exploit, reverse-engineer, or disrupt the Bot's functionality
• Not use the Bot for any illegal activities, harassment, or harmful purposes
• Not attempt to access data, servers, or configurations belonging to other users
• Not use automated tools, scripts, or bots to interact with Zenian in unauthorized ways
• Not attempt to circumvent tier restrictions, rate limits, or access controls
• Not impersonate Zenian staff or falsely claim affiliation with the Service
• Report any bugs, vulnerabilities, or exploits to the Zenian team responsibly

5. Server Administrator Responsibilities

Server administrators who add Zenian to their Discord servers accept additional responsibilities:

• Use the Bot's moderation and management features responsibly and fairly
• Do not abuse moderation tools (mass bans, frivolous infractions, etc.) against users without cause
• Comply with all applicable laws regarding data collection and user privacy within your server
• Inform your server members that Zenian is in use and what data it collects
• Ensure that bot permissions are configured correctly and not over-privileged
• Take responsibility for the actions of your staff members using the bot's features
• Not use network features to coordinate harassment or abuse across multiple servers
• Maintain reasonable logging and moderation practices that respect user privacy

6. Subscription Plans & Payments

Zenian offers three service tiers:

• Free: Basic features at no cost - no license key required. Includes tickets, suggestions, basic moderation, verification, and more
• Basic ($2.99/month): Enhanced features for growing communities including logging, auto-mod, reaction roles, giveaways, leveling, staff management, ER:LC integration, and more
• Premium ($4.99/month): Full access to all features including network management, bot profile customization, and priority support

Payment Terms

• All payments are processed through Patreon. By subscribing, you also agree to Patreon's Terms of Use
• Subscriptions are billed monthly on a recurring basis through Patreon
• Upon successful subscription, a license key will be automatically delivered to your Discord account via direct message. To receive your key automatically, you must have your Discord account linked to your Patreon account before subscribing
• If your Discord account is not linked to Patreon at the time of purchase, you may request your key by contacting an executive at [email protected] or by opening a ticket in our Discord support server
• License keys are non-transferable between servers unless explicitly permitted by Zenian staff
• All sales are final. Zenian does not accept refunds through Patreon
• Monthly subscriptions may be cancelled at any time through Patreon, but no partial refunds will be given for the current billing period
• If you cancel your Patreon subscription, your license key will remain active until the end of the current billing period
• We reserve the right to change pricing with 30 days advance notice to existing subscribers
• License keys may be revoked without refund for violation of these Terms
• Chargebacks or payment disputes filed through Patreon will result in immediate service termination and potential blacklisting

Key Delivery

License keys are delivered automatically via Discord direct message upon subscription through Patreon. If you do not receive your key, ensure your Discord account is linked to your Patreon account. Alternatively, you can:

• Ask an executive to manually issue your key using the in-bot command
• Email [email protected] with your Patreon email and Discord username
• Open a support ticket in our Discord server

Feature Changes

We reserve the right to move features between tiers, add new features to any tier, or modify feature availability. We will provide reasonable notice for changes that affect paid subscribers.

7. Verification Services

Roblox verification is provided through Roblox's official OAuth2 system. Important disclosures:

• Zenian is not affiliated with, endorsed by, or sponsored by Roblox Corporation
• Verification accuracy depends on data provided by Roblox's API and may be subject to API limitations or outages
• We never store or have access to your Roblox password
• You may unlink your Roblox account at any time using the /unverify command
• Group role bindings rely on Roblox API data and may have delays when group ranks change

8. ER:LC Integration

The Emergency Response: Liberty County (ER:LC) integration features are provided as-is:

• ER:LC features depend on the ER:LC API and may be affected by game updates or API changes
• We are not affiliated with or endorsed by the ER:LC development team
• Server key security is the responsibility of the server administrator
• Abuse of ER:LC integration features (e.g., unauthorized server commands) is strictly prohibited

9. Availability & Uptime

We strive for high availability but do not guarantee uninterrupted service:

• The Service may experience downtime for maintenance, updates, or unforeseen technical issues
• We will attempt to provide advance notice for planned maintenance when possible
• Service status can be monitored at zenian.org/status
• We are not liable for any losses, damages, or inconveniences resulting from service outages
• Third-party service outages (Discord API, Roblox API, ER:LC API) are outside our control

10. Global Ban Policy

Zenian enforces global bans across all servers using the bot. The following offenses may result in an immediate global ban:

• Racism / Hate Speech: Any form of racial discrimination, slurs, or hate speech targeting any group based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Predatory Behavior: Any form of predatory, grooming, sexual, or inappropriate behavior toward minors
• Compromised Accounts: Accounts confirmed to be compromised, hacked, or used for raiding, spamming, or phishing
• Sexism / Harassment: Persistent harassment, sexism, stalking, doxxing, or discriminatory behavior
• Discord TOS Violations: Severe violations of Discord's Terms of Service or Community Guidelines
• Underage Users: Users confirmed to be under 13 years of age (per Discord TOS requirements)
• Service Abuse: Attempting to exploit, hack, or disrupt Zenian's services or infrastructure
• Scamming: Using Zenian-powered servers to scam, defraud, or deceive other users

Global bans are applied at the discretion of the Zenian team. Evidence/proof is attached to ban records when available. Appeals can be submitted through our Discord support server via the ticket system.

11. Network Management

Server networks allow linked servers to share moderation actions (Premium tier):

• Network owners can ban, unban, and kick users across all linked servers simultaneously
• Shared blacklists and ticket blacklists are maintained across the network
• Network owners are fully responsible for the appropriate use of cross-server moderation features
• Abuse of network features for coordinated harassment will result in network dissolution and potential account bans
• Individual server administrators within a network may withdraw their server at any time

12. Intellectual Property

All rights, title, and interest in and to the Service, including but not limited to:

• The Zenian name, logo, branding, and visual identity
• The bot's source code, algorithms, and underlying technology
• The web dashboard design, interface, and user experience
• Documentation, marketing materials, and website content

are owned by the Zenian team. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without explicit written permission.

13. Defamation, Misinformation & False Statements

You may not publish, distribute, or spread false, misleading, or defamatory information about Zenian, its services, its team, or its brand. This includes but is not limited to:

• False claims about the Bot's functionality: Falsely alleging that Zenian contains malware, spyware, token grabbers, IP loggers, or any other malicious code
• Impersonation & fraud: Operating a fake bot, website, service, or Discord server that uses the Zenian name, branding, or likeness to deceive users, nuke servers, steal data, or otherwise cause harm
• Defamatory statements: Publishing false accusations that Zenian engages in illegal activity, data theft, scamming, or any other harmful conduct
• Fraudulent reviews or reports: Submitting fake reviews, false abuse reports, or fabricated complaints designed to damage Zenian's reputation
• Social engineering: Using false information about Zenian to manipulate, deceive, or mislead other users or communities

Enforcement Actions

Violations of this section are treated with zero tolerance. If you are found to be spreading false information about Zenian or using the Zenian name/brand to cause harm, we reserve the right to take any or all of the following actions:

• Immediate permanent ban from all Zenian services, including global ban across all servers using the bot
• DMCA takedown notices issued to hosting providers, domain registrars, and platforms hosting the infringing or defamatory content
• Report to Discord Trust & Safety for violations of Discord's Terms of Service, including impersonation, fraud, and platform manipulation
• Report to the FBI Internet Crime Complaint Center (IC3) at ic3.gov for cybercrimes including but not limited to: identity fraud, wire fraud, computer intrusion, intellectual property theft, and malicious cyber activity conducted under the Zenian name
• Reports to other applicable law enforcement agencies depending on jurisdiction and severity of the offense
• Pursuit of civil legal action for defamation, tortious interference, and damages where applicable

All enforcement actions are taken at the sole discretion of the Zenian team. We maintain detailed logs and evidence of all violations. By using this Service, you acknowledge that false statements causing material harm to Zenian may result in legal consequences beyond service termination.

14. User Content

Content you create or configure through Zenian (such as ticket panels, welcome messages, embed configurations, etc.) remains yours. However, you grant Zenian a non-exclusive license to store, process, and display this content as necessary to provide the Service.

15. Termination

We reserve the right to:

• Terminate or suspend access for users who violate these Terms, without prior notice
• Blacklist individual users or entire servers for abuse
• Discontinue the Service or any feature at any time, with reasonable notice when possible
• Revoke license keys without refund for Terms violations
• Remove or restrict access to any content that violates these Terms

You may stop using the Service at any time by removing the bot from your server. Upon removal, your server configuration data may be retained for a reasonable period to allow re-addition, after which it will be deleted.

16. Limitation of Liability

To the fullest extent permitted by applicable law:

• Zenian is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied
• We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service
• We are not responsible for actions taken by server administrators or other users using the bot's features
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim

17. Indemnification

You agree to indemnify, defend, and hold harmless the Zenian team from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

18. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration. You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Changes to Terms

We may update these Terms at any time. Significant changes will be announced in our Discord server. Continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
